This website and online store are owned and operated by Cassin Design Pty Ltd (ABN 15 117 294 318), trading as Justin Cassin (“Justin Cassin”, “we”, “us” or “our”).

These Terms of Service (“Terms”) govern your use of the Justin Cassin website, online store and related services (“Site”) and the purchase of products from us.

By accessing or using the Site or placing an order, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

1. USE OF OUR WEBSITE

You may use the Site only for lawful purposes and in accordance with these Terms.

You must not:

• interfere with or disrupt the Site or any servers or networks associated with it;
• attempt to gain unauthorised access to the Site, customer accounts or associated systems;
• introduce viruses, malicious software or other harmful material;
• use automated scraping, data-mining or similar technologies except where permitted by law or with our written permission;
• attempt to circumvent the security or operation of the Site;
• impersonate another person or provide false information;
• use the Site for fraudulent or unlawful activity; or
• use the Site in a manner that infringes the rights of Justin Cassin or another person.

We may temporarily suspend or restrict access to the Site where reasonably necessary for security, maintenance, legal or operational reasons.

We do not guarantee that the Site will always be available, uninterrupted or free from errors.

2. INTELLECTUAL PROPERTY

Unless otherwise stated, all content appearing on the Site, including the Justin Cassin name and logo, photographs, videos, graphics, designs, artwork, text, product names, product descriptions and other material, is owned by or licensed to Justin Cassin and is protected by applicable intellectual property laws.

You may view and use the Site for your personal, non-commercial purposes.

Except as permitted by law, you must not reproduce, copy, modify, distribute, publish, sell, commercially exploit or otherwise use our content without our prior written permission.

If you are a stylist, photographer, publication, influencer, media representative or other creative professional interested in using our content or collaborating with Justin Cassin, please contact contact@justincassin.com.

3. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, measurements, colours, specifications and other product information displayed on our Site are accurate.

However, the appearance and colour of products may vary depending on lighting, photography, your device and display settings.

Lifestyle, runway, campaign and other promotional imagery may be created or enhanced for editorial, advertising or promotional purposes and may not represent every product detail exactly.

Product measurements are approximate unless expressly stated otherwise.

Nothing in this section affects your rights under the Australian Consumer Law where a product does not correspond with its description, sample or other applicable consumer guarantee.

4. AVAILABILITY

All products are subject to availability.

Placing an item in your shopping cart does not reserve that product.

Occasionally, a product may become unavailable after an order has been placed because of stock discrepancies, simultaneous orders or other circumstances.

If we are unable to supply an ordered product, we will contact you and refund any amount paid for the unavailable product.

5. PRICES

Prices displayed on the Site may vary according to your selected country or region.

For Australian customers, prices are displayed in Australian dollars unless otherwise stated and include GST where applicable.

For international customers, prices may be displayed in another currency depending on your selected region and the functionality available through our online store.

Delivery charges, where applicable, will be displayed on the Site or during checkout before you complete your purchase.

International orders may also be subject to customs duties, taxes and other charges as described in these Terms.

We may change prices at any time. A price change will not affect an order that we have already accepted.

If an obvious pricing error occurs, we may contact you before accepting the order to give you the opportunity to purchase the product at the correct price or cancel the order.

6. ORDERS

When you place an order through the Site, you are making an offer to purchase the products contained in that order.

After placing your order, you may receive an email acknowledging that we have received it. An acknowledgement does not necessarily mean that your order has been accepted.

A contract for the purchase of the products is formed when we accept your order, which may occur when we confirm that your order has been processed or dispatched.

We may decline or cancel an order before acceptance where reasonably necessary, including where:

• a product is unavailable;
• there is an obvious pricing or product-description error;
• a product has mistakenly been included in a promotion;
• payment cannot be authorised;
• we reasonably suspect fraud or unauthorised payment activity;
• we reasonably suspect products are being purchased for unauthorised commercial resale; or
• we are otherwise unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method where reasonably practicable.

7. PAYMENT

You must pay the amount shown at checkout using one of the payment methods available through the Site.

By providing payment information, you confirm that you are authorised to use that payment method.

Payments may be processed by third-party payment providers.

Payment providers may conduct authorisation, security and fraud-prevention checks in accordance with their own terms and privacy practices.

Justin Cassin does not necessarily receive or store your complete credit or debit card information where payment is processed securely by a third-party payment provider.

8. ORDER CHANGES AND CANCELLATIONS

If you make an error after submitting an order or wish to change or cancel your order, please contact us as soon as possible at contact@justincassin.com.

We will make reasonable efforts to accommodate your request but cannot guarantee that an order can be changed or cancelled after processing or fulfilment has commenced.

If an order has already been dispatched, it will generally need to be dealt with under our Returns Policy and your rights under applicable consumer law.

9. DELIVERY

We deliver to the destinations made available through our checkout.

Available delivery methods, estimated delivery times and applicable delivery charges will be displayed on the Site or during checkout.

Delivery dates and times are estimates unless we expressly state otherwise.

We will make reasonable efforts to dispatch and deliver orders within the estimated timeframe. However, delays may occur because of carriers, customs processing, weather, peak periods, public holidays or circumstances outside our reasonable control.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

You are responsible for providing an accurate and complete delivery address.

If you provide authority for a carrier to leave a parcel unattended, delivery may occur in accordance with that authority and the carrier’s applicable procedures.

If an order cannot be delivered because the address provided was incorrect or incomplete, or because delivery or collection was not reasonably accepted, you may be responsible for reasonable additional delivery or return costs to the extent permitted by law.

10. INTERNATIONAL ORDERS, CUSTOMS AND DUTIES

Justin Cassin is an Australian business and may ship products internationally to selected destinations.

International orders may be subject to import duties, taxes, customs charges, brokerage fees or other government charges imposed by the destination country.

Unless expressly stated during checkout that these charges are included in the purchase price, the recipient is responsible for applicable import duties, taxes and customs charges imposed by the destination country.

Customs thresholds, duties and tax rules vary between countries and may change from time to time.

Customers placing international orders are responsible for checking the requirements that apply in their destination country.

Your bank, card issuer or payment provider may also impose currency conversion or international transaction fees. These fees are determined by the relevant provider and are outside our control.

11. RETURNS AND CHANGE OF MIND

Change-of-mind returns are governed by our Returns Policy.

Any change-of-mind return rights voluntarily provided by Justin Cassin are additional to your rights under the Australian Consumer Law.

Change-of-mind returns may be subject to reasonable conditions specified in our Returns Policy, including requirements relating to:

• the period in which the return must be requested;
• the condition of the product;
• original tags and packaging;
• proof of purchase; and
• products excluded from change-of-mind returns where permitted by law.

These conditions do not restrict your statutory rights in relation to faulty products or other rights available under the Australian Consumer Law.

12. AUSTRALIAN CONSUMER LAW AND FAULTY PRODUCTS

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

These consumer guarantees include requirements that goods are of acceptable quality, are fit for any disclosed purpose and correspond with their description.

If you believe that a product is faulty, defective, unsafe, materially different from its description or otherwise fails to comply with an applicable consumer guarantee, please contact us at contact@justincassin.com.

We may ask you to provide information, photographs or other reasonable evidence so that we can assess the issue.

Your remedy will depend on the circumstances and your rights under the Australian Consumer Law.

Where there is a major failure, you may be entitled to reject the goods and choose a refund or replacement. You may also be entitled to compensation for reasonably foreseeable loss or damage.

Where a failure is not major, we may be entitled to provide an appropriate remedy within a reasonable period.

Consumer guarantees apply for the period that is reasonable having regard to matters such as the nature, price and expected life of the product. Your statutory rights are not necessarily limited to the period specified in a voluntary returns or warranty policy.

Normal wear and tear, accidental damage, misuse or damage resulting from use of a product in a way that was not reasonably intended does not necessarily constitute a failure under the Australian Consumer Law.

Nothing in these Terms or our Returns Policy excludes, restricts or modifies rights that cannot lawfully be excluded, restricted or modified.

13. PROMOTIONS, SALES AND DISCOUNT CODES

From time to time, Justin Cassin may offer sales, promotions, discount codes or other special offers.

Specific terms may apply to individual promotions.

Unless otherwise stated:

• promotions apply only during the specified promotional period;
• promotional offers may be subject to product availability;
• discount codes cannot be redeemed for cash;
• discount codes may be restricted to one use per customer or order;
• particular products or collections may be excluded;
• multiple discount codes or promotions may not be combined; and
• a promotion may be available only in particular countries or regions.

Promotion-specific conditions apply in addition to these Terms.

Nothing in a promotion or its conditions excludes rights that cannot lawfully be excluded under the Australian Consumer Law.

14. GIFT CARDS

Where Justin Cassin offers gift cards, additional conditions displayed when the gift card is purchased or issued may apply.

Gift cards will be provided with an expiry period that complies with applicable Australian law.

Gift cards cannot be redeemed for cash except where required by law.

Lost or stolen gift cards may not be replaceable unless required by law or otherwise stated in the applicable gift-card conditions.

15. CUSTOMER ACCOUNTS

Where our Site allows you to create a customer account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

You should contact us promptly if you believe your account has been accessed without authorisation.

We may suspend or restrict an account where reasonably necessary to protect you, Justin Cassin or other customers from suspected fraud, misuse or security threats.

16. REVIEWS AND USER CONTENT

If you submit a product review, photograph, video, comment or other content to us or through the Site, you confirm that:

• you have the right to provide the content;
• the content is not unlawful, defamatory, fraudulent or misleading;
• the content does not infringe another person’s intellectual property, privacy or other rights; and
• the content does not contain malicious software or harmful material.

Where you provide content specifically for publication or promotional use, you grant Justin Cassin a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purposes for which it was submitted, subject to applicable law.

We may moderate or remove content where reasonably necessary.

We will not manipulate or selectively present customer reviews in a way that is false or misleading.

17. THIRD-PARTY SERVICES AND LINKS

Our Site may contain links to or integrate with third-party websites, payment services, social-media platforms or other services.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

The inclusion of a third-party link does not necessarily indicate that Justin Cassin endorses that third party or its products or services.

Third-party services may be subject to their own terms and privacy policies.

18. PRIVACY

We collect, use, disclose and protect personal information in accordance with applicable privacy laws and our Privacy Policy.

Our Privacy Policy explains how we handle personal information collected through the Site and in connection with purchases and interactions with Justin Cassin.

19. WEBSITE SECURITY

Although we take reasonable measures to protect the Site, we cannot guarantee that the Site will always be free from viruses, malicious software or other security threats.

You are responsible for taking reasonable precautions when accessing websites and downloading information.

You must not knowingly introduce viruses, malicious code or other harmful technology to the Site.

20. LIABILITY

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law where it would be unlawful to do so.

To the maximum extent permitted by law, Justin Cassin will not be liable for loss or damage that was not reasonably foreseeable or that results from circumstances outside our reasonable control.

Any exclusion or limitation of liability contained in these Terms applies only to the extent permitted by law.

21. INDEMNITY

To the extent permitted by law, you agree to indemnify Justin Cassin against loss reasonably incurred as a direct result of your unlawful use of the Site, your material breach of these Terms or your infringement of another person’s rights.

This indemnity does not apply to the extent that the loss was caused or contributed to by Justin Cassin or where applying the indemnity would be prohibited by law.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Site, products, business practices, technology or applicable laws.

The current version will be published on the Site together with the date on which it was most recently updated.

Changes will not retrospectively alter the terms applicable to an order that we have already accepted unless required by law or agreed with you.

23. GOVERNING LAW

These Terms are governed by the laws applicable in New South Wales, Australia.

You and Justin Cassin submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws concerning the jurisdiction in which proceedings may be brought.

24. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

25. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Returns Policy and any other terms expressly applicable to your order, constitute the terms governing your use of the Site and purchases from Justin Cassin.

If there is an inconsistency between these Terms and specific terms expressly stated for a promotion or product, the specific terms will apply to the extent of the inconsistency, subject always to applicable law.
